Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the DunaHub app, website, and services, operated by DUNA DESIGN MARKETING E TECNOLOGIA LTDA (“DunaHub”, “we”). By creating an account or using the service, you agree to these Terms.

1. Acceptance

By accessing or using DunaHub you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the service.

2. Description of Service

DunaHub is a CRM (Customer Relationship Management) software offered as a service (SaaS) for small and medium businesses. It includes — subject to availability and your plan — a visual pipeline, unified inbox (WhatsApp, SMS, email, webchat), scheduling, invoices, proposals, Conversation AI, NFS-e issuance (Brazil), Money Dashboard, Payroll (CRA), and other features described at www.dunahub.com.

3. Eligibility and Account

  • You must be at least 18 years old and legally able to contract.
  • Information you provide must be accurate and up to date.
  • You are responsible for the security of your account, password, and all activity under it.
  • Notify us immediately of any unauthorized use.

4. Plans and Payment

  • Free plan: available with no credit card, subject to limits described at Free plan limits.
  • Paid plans (Starter, Pro, Growth): billed monthly on a recurring subscription.
  • Processing: Stripe (US) or Asaas (BR — coming soon). You authorize automatic charges to your saved payment method.
  • Taxes: prices exclude applicable taxes, where due.
  • Refunds: no prorated refunds for unused periods after cancellation.
  • Non-payment: if a charge fails, we may suspend or terminate access after notice.
  • Price changes: communicated at least 30 days in advance and take effect on the next billing cycle.

5. Acceptable Use

You agree not to:

  • Use the service for illegal, fraudulent, or rights-violating activity.
  • Send spam, unsolicited messages, or abusive content via WhatsApp, SMS, or email without a lawful basis and adequate consent.
  • Reverse engineer, decompile, or try to access the source code.
  • Interfere with the security or integrity of the service.
  • Resell, sublicense, or make the service available to third parties without written authorization.
  • Use the service to automate mass messaging that violates the rules of messaging platforms (WhatsApp Business, Twilio, email providers).

6. Intellectual Property

  • DunaHub, including its software, design, brand, and content, is owned by DUNA DESIGN MARKETING E TECNOLOGIA LTDA and protected by copyright and trademark law.
  • We grant you a limited, non-exclusive, revocable license to use the service under these Terms.
  • Data you enter (leads, customers, messages, invoices, tax records) remains your property. You may export it at any time while your account is active.

7. WhatsApp, SMS, and Email Communications

When using DunaHub to send messages to your contacts, you represent that:

  • You have a valid legal basis or consent to communicate with each recipient.
  • You will comply with WhatsApp Business, Twilio, email provider policies, and applicable anti-spam laws (LGPD, CAN-SPAM, TCPA, CASL).
  • You are solely responsible for the content you send. DunaHub only provides the infrastructure.

8. Suspension and Termination

  • You may cancel your subscription anytime under Settings → Subscription. Access remains until the end of the paid period.
  • We may suspend or terminate your account for breach of these Terms, non-payment, or legal requirement, with prior notice where possible.
  • After termination, your data will be deleted per the Privacy Policy.

9. Disclaimers and Limitation of Liability

The service is provided “as is” and “as available.” We do not warrant that it will be uninterrupted, error-free, or fully secure. To the maximum extent permitted by law, DunaHub's total liability for any claim related to the service is limited to the amount you actually paid in the 12 months prior. In no event will we be liable for lost profits, lost data, or indirect, incidental, or consequential damages.

10. Indemnification

You agree to indemnify and hold DunaHub, its owners, directors, and staff harmless from third-party claims arising from your use of the service, breach of these Terms, or violation of third-party rights.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by email or in the platform at least 15 days in advance. Continued use after the effective date constitutes acceptance.

12. Governing Law and Venue

These Terms are governed by the laws of the Federative Republic of Brazil, including the LGPD. The venue for any dispute is the court of the district of DUNA DESIGN MARKETING E TECNOLOGIA LTDA's headquarters, waiving any other, however privileged. For users in the United States, the laws of the State of Florida additionally apply, without prejudice to the rights guaranteed by local consumer law.
